4.1 Comply with statutory frameworks that underpin service provision

During the course of your work, you will come across statutory frameworks that underpin service provision. These are essential to ensure that high standards are maintained. When working with people it is important to be aware of these frameworks and comply with them at all times.

To demonstrate that you comply with statutory frameworks that underpin service provision, you must reflect on examples from your own work and show how you have been aware of them.

It is essential that you have a good understanding of the statutory frameworks relating to your area of work, and have knowledge of local and national policies. Knowledge of statutory frameworks and ways to comply with them is also important for you as an individual, as it supports your work with people and helps you to support them in the most effective way.

What are the key areas of compliance?

As a care worker, you will be expected to meet many different requirements from statutory bodies such as the Care Quality Commission (CQC), Local Safeguarding Children Boards (LSCBs), and the National Institute of Health and Care Excellence (NICE).

2) Consent

One of the key principles within safeguarding is gaining informed consent from those you support, their families, and carers where appropriate before any activity takes place. This helps to ensure that they are able to give real consideration to what they are being asked for, or told they need to do. There are four main areas where this principle is applied within service delivery:

• Physical contact – who can you touch? How? Why? When? For how long? Under what circumstances?
• What information goes into their care plan – what details about themselves must never be shared without their explicit consent?
• What activities are planned for them – what must they agree to before any plan will be implemented? How can you ensure that they are able to make this decision without feeling pressured in any way?
• What information are you legally required to share with others – who else needs to know certain things about them, and when do they need to know it?

There is no room for misunderstanding when applying the principle of informed consent. It is therefore essential that you take into account these four main areas in line with your own role in safeguarding. This ensures that all activities within your care delivery comply with statutory frameworks.

3) Risk assessment 

Working as a care worker requires the undertaking of a high number of complex activities. To ensure your own safety and that of everyone else in your care when doing these activities, it is important to undertake risk assessments for every task you complete. Risk assessments help to identify potential hazards and how these can be managed in such a way that the activity continues safely.

Every care worker must understand what constitutes a ‘risk’ when carrying out their role, no matter what they are doing or where they are doing it. For example:

• What might happen if I didn’t complete this activity?* How could I make sure this doesn’t happen?
• If my client suddenly becomes distressed, is there somewhere safe and calm we can go together while we wait for help to arrive?
• Does the activity I’m planning on doing with my client require any additional risks to be identified and managed? If so, what are they?
